While Delta-8 THC occurs naturally in the hemp plant, it is in very low concentrations. To provide the level of Delta-8 THC required for the production of commercially available products, most of the Delta-8 THC is synthetic, created through a process that uses a derivative from cannabidiol in hemp plants. As long as Delta-8 THC products are produced to contain less than 0.3% THC (Delta-9 THC), they are considered legal. In some states, this is seen as a loophole in the law and is under review. This is causing some to initiate the ban of Delta-8 THC products as containing a controlled substance.
